Please read these Terms of Service ("Terms") carefully before using the TradeLens: AI Insights mobile application (the "Service") operated by GradientStudios ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Eligibility and Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use the Service. We do not knowingly allow persons under 18 to create accounts.

3. Use of Service

You agree to use the Service only for lawful purposes. You are responsible for all activities that occur under your account. You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Reproduce, duplicate, copy, sell, or resell any part of the Service without our express written permission.

4. Artificial Intelligence (AI) Content

The Service utilizes Artificial Intelligence to generate market insights and analysis. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or misleading.
• You must verify any information generated by the AI before relying on it.
• We do not guarantee the accuracy, completeness, or timeliness of AI outputs.
• Past market performance is not indicative of future results. Any analysis or patterns identified by the AI should not be interpreted as a prediction of future market behavior.
• AI analysis does not account for your personal financial situation, investment goals, risk tolerance, tax situation, or any other individual circumstances.

5. No Financial Advice

• GradientStudios does not hold any financial advisor license, investment advisor registration, or any regulated financial services authorization in any jurisdiction.
• Nothing in the Service should be construed as a recommendation to buy, sell, or hold any financial instrument, security, currency, or other asset.
• You should not make any investment or financial decision based solely or primarily on information provided by this Service.
• You should always consult with a qualified, licensed financial professional before making any investment or financial decisions.
• We are not responsible for any financial losses, trading losses, or other damages incurred as a result of using this Service or relying on its outputs.

6. Market Data Disclaimer

Market data and price information displayed within the Service may be:

• Delayed and not real-time.
• Inaccurate, incomplete, or subject to errors from our data providers.
• Sourced from third-party providers over whom we have no control.

Market data is provided for informational purposes only and is not suitable as a sole basis for trading or investment decisions. We make no warranty regarding the accuracy, timeliness, or completeness of any market data displayed.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

GradientStudios does not warrant that:

• The Service will function uninterrupted, securely, or be available at any particular time or location.
• Any errors or defects will be corrected.
• The Service is free of viruses or other harmful components.
• The results of using the Service will meet your requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRADIENTSTUDIOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, business, or goodwill.
• Trading losses or investment losses of any kind.
• Cost of substitute services.
• Any other intangible losses.

RESULTING FROM (i) YOUR USE OR INABILITY TO USE THE SERVICE; (ii) ANY CONTENT OBTAINED FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (iv) ANY OTHER MATTER RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRADIENTSTUDIOS' TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (a) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) TEN EUROS (€10).

9. Subscriptions and Payments

The Service offers optional paid subscription plans ("Premium") that provide access to additional features.

• Billing: Subscription payments are processed exclusively through the Apple App Store or Google Play Store, as applicable. We do not directly collect or store your payment card information.
• Recurring billing: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
• Refunds: Refund requests are subject to the policies of Apple App Store or Google Play Store. We have no ability to process refunds directly.
• Price changes: We reserve the right to change subscription prices. We will notify you of any price changes and your continued subscription after the change constitutes acceptance.

10. Intellectual Property

The Service and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of GradientStudios. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

11. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

• Violates these Terms or any applicable law.
• Is harmful to other users, third parties, or the Service.
• Involves fraudulent activity.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Force Majeure

GradientStudios shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, government actions, internet or telecommunications outages, failures of third-party AI providers or market data providers, power failures, or other events of force majeure.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal and applicable European Union law, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal, except where EU consumer protection law provides otherwise.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be deemed severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the Service.
